IL CONSIGLIO DELL’UNIONE EUROPEA,

visto il trattato sul funzionamento dell’Unione europea, in particolare l’articolo 291, paragrafo 2,

visto il regolamento (CE) n. 1346/2000 del Consiglio, del 29 maggio 2000, relativo alle procedure di insolvenza (1) , in particolare l’articolo 45,

vista la proposta della Commissione europea,

considerando quanto segue:

Gli allegati A, B e C del regolamento (CE) n. 1346/2000 elencano le denominazioni date nella legislazione nazionale degli Stati membri alle procedure e ai curatori cui si applica il regolamento. L’allegato A elenca le procedure di insolvenza di cui all’articolo 2, lettera a), di tale regolamento. L’allegato B elenca le procedure di liquidazione di cui all’articolo 2, lettera c), di tale regolamento e l’allegato C elenca i curatori di cui all’articolo 2, lettera b), di tale regolamento.

In data 2 marzo 2009 il Belgio ha notificato alla Commissione, conformemente all’articolo 45 del regolamento (CE) n. 1346/2000, le modifiche da apportare agli elenchi degli allegati A e C di tale regolamento. Tale notifica è stata successivamente adattata dal Belgio in modo da integrare le modifiche degli elenchi di cui agli allegati A e C ed aggiungere una modifica dell’elenco di cui all’allegato B.

A seguito delle modifiche apportate agli allegati A, B e C del regolamento (CE) n. 1346/2000 successivamente alla suddetta notifica da parte del Belgio e al susseguente adattamento della stessa, è opportuno procedere ad una codificazione degli allegati A, B e C di tale regolamento, per offrire la necessaria certezza del diritto a tutti i soggetti coinvolti in procedure di insolvenza contemplate da tale regolamento.

Il Regno Unito e l’Irlanda sono vincolati dal regolamento (CE) n. 1346/2000 e pertanto, ai sensi dell’articolo 45 del medesimo, partecipano all’adozione e all’applicazione del presente regolamento.

A norma degli articoli 1 e 2 del protocollo sulla posizione della Danimarca allegato al trattato sull’Unione europea e al trattato sul funzionamento dell’Unione europea, la Danimarca non partecipa all’adozione del presente regolamento, non è da esso vincolata né è soggetta alla sua applicazione.

È opportuno pertanto modificare e codificare di conseguenza gli allegati A, B e C del regolamento (CE) n. 1346/2000,

HA ADOTTATO IL PRESENTE REGOLAMENTO:

Articolo 1

Il regolamento (CE) n. 1346/2000 è modificato come segue:

nell’allegato A le denominazioni per il Belgio sono sostituite dal testo seguente:

Articolo 2

Gli allegati A, B e C del regolamento (CE) n. 1346/2000, come modificati in conformità dell’articolo 1 del presente regolamento, sono codificati e sostituiti dai testi figuranti negli allegati I, II e III del presente regolamento.

Articolo 3

Il presente regolamento entra in vigore il ventesimo giorno successivo alla pubblicazione nella Gazzetta ufficiale dell’Unione europea .

Articolo 4

Il presente regolamento è pubblicato nella Gazzetta ufficiale dell’Unione europea .

Il presente regolamento è obbligatorio in tutti i suoi elementi e direttamente applicabile negli Stati membri conformemente ai trattati.
