L'article 37 du règlement (CE) n° 1346/2000 du Conseil du 29 mai 2000 relatif aux procédures d'insolvabilité(1) qui prévoit la possibilité de convertir une procédure territoriale ouverte avant la procédure principale en une procédure de liquidation est à interpréter dans ce sens que cette conversion n'exclut ni l'appréciation de l'état de la procédure locale par le juge (comme dans le cas de l'article 36) ni la prise en compte de l'ordre public conformément à l'article 26.
