IL CONSIGLIO DELL’UNIONE EUROPEA,

visto il trattato che istituisce la Comunità europea,

visto il regolamento (CE) n. 1346/2000 del Consiglio, del 29 maggio 2000, relativo alle procedure di insolvenza (1) , in particolare l’articolo 45,

vista la proposta della Commissione,

considerando quanto segue:

Gli allegati del regolamento (CE) n. 1346/2000 elencano le denominazioni date nella legislazione nazionale degli Stati membri alle procedure e ai curatori a cui si applica il regolamento. L’allegato A di detto regolamento elenca le procedure di insolvenza di cui all’articolo 2, lettera a), di tale regolamento. L’allegato B elenca le procedure di liquidazione di cui all’articolo 2, lettera c), e l’allegato C elenca i curatori di cui all’articolo 2, lettera b), di tale regolamento.

Gli allegati A, B e C del regolamento (CE) n. 1346/2000 sono stati modificati dall’atto di adesione del 2003 con l’obiettivo di includere le procedure di insolvenza, le procedure di liquidazione e i curatori dei nuovi Stati membri.

Belgio, Spagna, Italia, Lettonia, Lituania, Malta, Ungheria, Austria, Polonia, Portogallo e Regno Unito hanno notificato alla Commissione, ai sensi dell’articolo 45 del regolamento (CE) n. 1346/2000, le modifiche agli elenchi riportati negli allegati A, B e C di tale regolamento.

Il Regno Unito e l’Irlanda hanno notificato, conformemente all’articolo 3 del protocollo sulla posizione del Regno Unito e dell’Irlanda allegato al trattato sull’Unione europea e al trattato che istituisce la Comunità europea, che desiderano partecipare all’adozione ed applicazione del presente regolamento.

La Danimarca a norma degli articoli 1 e 2 del protocollo sulla posizione della Danimarca allegato al trattato sull’Unione europea ed al trattato che istituisce la Comunità europea, non partecipa all’adozione del presente regolamento e di conseguenza non è vincolata da esso, né è soggetta alla sua applicazione.

Il regolamento (CE) n. 1346/2000 dovrebbe essere pertanto modificato,

HA ADOTTATO IL PRESENTE REGOLAMENTO:

Articolo 1

Il regolamento (CE) n. 1346/2000 è modificato come segue:

1)

l’allegato A è sostituito dal testo riportato nell’allegato I del presente regolamento;

2)

l’allegato B è sostituito dal testo riportato nell’allegato II del presente regolamento;

3)

l’allegato C è sostituito dal testo riportato nell’allegato III del presente regolamento.

Articolo 2

Il presente regolamento entra in vigore il giorno successivo alla pubblicazione nella Gazzetta ufficiale dell’Unione europea .

Il presente regolamento è obbligatorio in tutti i suoi elementi e direttamente applicabile negli Stati membri in base al trattato che istituisce la Comunità europea.
